Digital asset broker regulations

The digital asset broker regulations are the Treasury rules, finalized in 2024, that require exchanges and certain other brokers to report customer sales of digital assets to the IRS on Form 1099-DA, beginning with 2025 transactions.

The rules cover custodial exchanges, hosted wallet providers, and payment processors. A separate rule that would have reached DeFi front-end services was repealed by Congress in 2025. Cost basis reporting phases in for assets acquired in 2026 and later.

Why it matters: for the first time the IRS receives third-party data on crypto sales at scale, which is what makes automated matching and notices possible. See Form 1099-DA.
